This Acceptable Use Policy (“AUP”) sets out what customers may and may not do with the Brazen.AI platform. The AUP is incorporated into the Terms of Service and applies to every user of the Service, including end-users granted access by a customer.
Scope
This AUP governs all content, configuration, prompts, audiences, creative, landing pages, and campaigns produced or deployed using the Service. Customers are responsible for the activity of their users and for any output the Service produces on their behalf.
Prohibited content
You may not use the Service to create, distribute, or amplify content that:
- Is illegal in the jurisdiction where it is created or where it is delivered.
- Infringes intellectual-property rights, trade secrets, or rights of publicity.
- Is harassing, threatening, defamatory, or hateful.
- Sexually exploits or endangers minors in any way; sexual content involving minors is strictly prohibited.
- Promotes terrorism, violent extremism, or self-harm, or facilitates the planning or execution of violence.
- Contains malware, ransomware, or other malicious code.
- Misrepresents identity, affiliation, or endorsement (including by impersonating a person, brand, or government entity).
- Makes deceptive claims about products or services, including guaranteed financial returns, medical cures, or weight-loss outcomes that cannot be substantiated.
- Promotes regulated categories — for example, weapons, illegal drugs, gambling without proper licensing, payday lending, MLM, or counterfeit goods — outside applicable legal frameworks.
Prohibited conduct
You may not use the Service to:
- Send unsolicited bulk messaging that violates CAN-SPAM, CASL, the GDPR, the ePrivacy Directive, or local marketing laws.
- Scrape, crawl, or extract data from third-party platforms in violation of those platforms' terms of service.
- Interfere with the integrity or performance of the Service, including denial-of-service attacks, automated abuse of API endpoints, or attempts to bypass rate limits or security controls.
- Engage in ad fraud, click fraud, conversion fraud, or any conduct designed to misrepresent advertising performance.
- Reverse engineer, decompile, or attempt to extract model weights, training data, or proprietary algorithms from the Service.
- Re-sell, sub-license, or white-label the Service without our prior written agreement.
- Upload to the Service any data that you do not have a lawful basis to process — including special categories of personal data, government identifiers, payment-card data, or protected health information — unless we have agreed in writing.
AI-specific restrictions
Because the Service uses generative AI, the following restrictions apply in addition to the rules above:
- No deepfakes of identifiable people without documented, verifiable consent from each person depicted.
- No discriminatory targeting. You may not configure the Service to target advertising for housing, employment, credit, or insurance based on protected characteristics. Customers running ads in those verticals must comply with Special Ad Category rules on Google and Meta.
- No undisclosed political or election advertising. Political, electoral, and social-issue advertising is permitted only where the advertiser is verified by the relevant ad platform and where the “paid for by” disclosure is included on the creative.
- No deceptive health, financial, or scientific claims. AI-generated copy must not assert outcomes that cannot be substantiated, especially in regulated verticals.
- Disclose AI involvement where required by law (including the EU AI Act's transparency obligations) and by ad-platform policy (for example, Meta's requirement to disclose digitally created or altered content for political or social-issue ads).
Reporting violations
If you become aware of content or activity that violates this AUP, report it to legal@brazen.ai. We review reports promptly and treat genuine reports confidentially.
Enforcement
We may investigate suspected AUP violations and take action including warning, requiring removal of content, suspending features, suspending the account, or terminating the agreement. Where the conduct poses imminent risk of harm, we may act without prior notice. We cooperate with law enforcement and other competent authorities as required by law.
